1. Scope and operator
These terms describe how you may use the Emolysis website at emolysis.com and its content. The website is operated by Bandpey GmbH, Gmunder Str. 20b, 81379 Munich, Germany.
They cover the public website only. They do not replace an individually agreed contract, a confidentiality agreement or a software license, and they are not the terms for using the Emolysis product.
2. The product and its terms
Emolysis is in private development and nothing is released. The terms for using Emolysis itself, such as accounts, plans, credits, billing and acceptable use of the service, will be published before launch.
Until then, nothing on this website gives you access to the product or a license to use it. Visiting the website does not create an order, a consulting relationship or any other contract.
3. Information, not advice
The website gives general information about Emolysis and how it is designed to work. Statements about features, platforms, plans and prices describe what we plan. They may change before release, and they are not a binding offer, a promise that a feature will exist or a guarantee of a result. Prices on the pricing page are planned prices.
Documentation, tutorials and examples may simplify a subject or describe the planned workflow before it exists. Check that they fit your situation before you rely on them, and get professional advice where a decision needs it.
4. Intellectual property
The website's text, graphics, designs and software are protected by copyright and other rights that belong to Bandpey GmbH or to the relevant rights holders. Emolysis and its logo are our marks. Names of other companies and products, such as the data platforms Emolysis targets, belong to their owners. We use them only to say what Emolysis works with, and that does not mean they endorse Emolysis or partner with us.
You may browse the website, and download or print material for your own use or to evaluate Emolysis, if you keep the copyright and other notices and do not present changed material as ours. The press kit says how to use the logo and the boilerplate to refer to Emolysis.
For any other use, such as copying, republishing, distributing or selling material, ask the rights holder first. This does not restrict statutory exceptions or rights that cannot lawfully be excluded. Material that we publish as open source stays under its own license.
5. Acceptable use
Use the website lawfully and respect the rights of others. In particular, do not:
- introduce malicious software or interfere with the website's security or availability;
- send automated requests in a way that disrupts the service;
- try to reach areas or data you are not meant to reach;
- use our contact channels for fraud, impersonation, harassment or unsolicited bulk messages.

6. Sample data
Dashboards and charts on the website use synthetic sample data and are labeled as such. They show what Emolysis is designed to produce. They are not real results, and they say nothing about any person's or company's data.
7. Messages you send us
Only send information you are entitled to share, and keep it to what we need to answer you. Please do not send credentials, keys, trade secrets, customer data or other confidential material by email.
Sending a message does not create a duty of confidentiality, and it does not transfer ownership of what you send. You keep your rights, and you do not give us a right to publish it or to use it to train AI models. We do not invite unsolicited ideas or inventions. If you send one, we are not obliged to evaluate, use or pay for it, and it does not stop us developing similar ideas independently.

8. Links to other websites
The website links to other sites. A link does not mean that we endorse their content or accept their terms for you. They have their own terms and privacy notices, so read them before you use those services or give them information.
We do not control later changes to other sites. If you think a link leads to unlawful content, tell us at hello@emolysis.com.
9. Availability and liability
We aim to provide useful, accurate information and a working website. We do not promise uninterrupted availability, or that every item is complete or up to date. Maintenance, faults and changes can affect access.
These terms do not exclude or limit liability for intent or gross negligence, for injury to life, body or health, for fraud, for guarantees we have given, or any other liability that cannot lawfully be excluded. Beyond that, we are liable as the law provides. Your statutory rights as a consumer are not affected.
10. Privacy and cookies
The website sets cookies for its analytics once you choose in its cookie banner. What it does process is described in the privacy notice. These terms are not privacy information, and they are not consent to any processing.
11. Governing law and courts
Where these terms form part of a contract, German law applies. This choice does not deprive consumers of the mandatory protections of the law that would otherwise apply, including the law of their habitual residence.
The courts with jurisdiction are those the law determines, unless a valid separate agreement on jurisdiction applies. These terms give Bandpey GmbH no right to pick a court on its own, and they do not restrict a consumer's mandatory right to sue where the law gives it.
12. Changes and severability
We may update these terms when the website or the law changes. The date at the top shows the latest version. A new version does not change an agreement that already exists.
If a provision is invalid or does not become part of an agreement, the rest stays in effect, and the law decides what applies in its place.
